This website is operated by customportraits.shop. Throughout the site, the terms “we”, “us” and “our” refer to customportraits.shop. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.

• You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

• A breach or violation of any of the Terms will result in an immediate termination of your Services.

Section 2 - General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

• Refusal of Artwork: We reserve the right to decline any order involving reference photos that are sexually explicit, hateful, racist, illegal, or otherwise offensive. In such cases, the order will be cancelled and fully refunded.

• You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Section 3 - Products & Services (Digital Goods)

• Nature of Product: You acknowledge that the products available for purchase on this site are Digital Downloads. No physical item, frame, or print will be shipped to your address.

• Delivery: Delivery is performed via email or digital download link. It is your responsibility to ensure your email address is correct and to download the file upon receipt.

• Color Accuracy: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate. Furthermore, printed results may vary depending on the printer, ink, and paper used.

Section 4 - Intellectual Property & Usage Rights

This is a critical section regarding the ownership of the artwork we create for you.

• Personal Use Only: By purchasing a custom portrait, you are granted a non-exclusive, perpetual license to use the image for Personal Use (e.g., printing for your home, posting on your personal social media, gifting to a friend).  

   

• No Commercial Use: You may not resell, redistribute, or use the artwork for commercial purposes (e.g., you cannot print our drawing on t-shirts to sell to others) without our express written permission.  

   

• Artist Rights: customportraits.shop retains the copyright to all illustrations created. We reserve the right to use the artwork in our portfolio or marketing materials. (Note: We respect your privacy; if you do not want your artwork displayed publicly, please email us to opt-out).  

   

Section 5 - Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.  

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.  

Section 7 - Third-Party Tools & Links

We may provide you with access to third-party tools (such as file upload services or printing partners) over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” without any warranties, representations, or conditions of any kind.

Section 8 - User Comments, Feedback, and Other Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

Section 9 - Limitation of Liability

In no case shall customportraits.shop, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of any of the service or any products procured using the service.

• Specifically, we are not liable for the quality of the final print if you choose to print the file at a third-party print shop or home printer.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of [Insert Your Country/State].
